FAMM is a nonpartisan, nonprofit organization that advocates for fair and individualized sentencing and prison policies that are just and cost-effective, protect public safety, and strengthen families. FAMM’s mission is to create a more fair and effective justice system that respects our American values of individual accountability and dignity while keeping our communities safe. One of FAMM’s core programs is promoting compassionate release, which provides for an individual’s release from prison when illness, age, or other circumstances lead to the conclusion that continued incarceration no longer serves the ends of justice.

FAMM is seeking a lawyer to support our work on state compassionate release laws, regulations, and practices. Most states permit some form of early release from prison for individuals who are severely disabled, ill, and/or near death. In 2018 we conducted a fifty-state (and the District of Columbia) survey outlining the laws and rules governing compassionate release. The results of that survey are presented in memos [1] on our website designed to help incarcerated individuals, their loved ones, policy makers and reform advocates understand the current state of compassionate release. We also produced a report [2], Everywhere and Nowhere: Compassionate Release in the States, identifying best practices as well as common barriers to effective early release programs. Our work in this area has led to reform efforts in several states. We plan to build on that advocacy in 2021.

Since the memos and report were written, several states have amended compassionate release authority. We wish to update the memos and issue a new report in 2021.

We are seeking a lawyer with legislative and regulatory research experience who can 1. review the status of state compassionate release statutes and regulations, and identify any changes that our memos do not reflect, and 2. update any outdated state memos.

This is a job well suited to a recent law school graduate, or a more experienced attorney seeking a temporary position.

You should be a law school graduate, have excellent legislative and regulatory research skills, and be a clear writer (including being able to write for a lay audience) and communicator. You will work with FAMM’s General Counsel, and to a lesser extent with our Storyteller and Communications team.

This is a temporary contract position. Compensation will depend on experience.
